Terms of Use

01Licence to use

Subject to these Terms, HSY Labs grants you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Apps on devices that you own or control, in accordance with the usage rules of the platform from which you obtained them.

02Acceptable use

When using the Apps, you agree not to:

• use them for unlawful, fraudulent or harmful purposes;
• copy, modify, distribute, sell or rent them, or attempt to decompile or reverse engineer them, except as permitted by law;
• circumvent security measures, usage limits or technical protections;
• interfere with their operation or with their use by other people;
• use them to infringe the rights of third parties.

03Accounts and content

Some Apps may let you create an account or add content. You are responsible for keeping your credentials confidential and for the content you add, which must not break the law or infringe the rights of others. You keep your rights over your content and grant us only the permissions needed to operate the App for you.

04Purchases and subscriptions

Purchases and subscriptions are processed by the platform from which you obtained the App, such as Google Play or the App Store, and are subject to its terms, including its payment, billing and refund policies.

Subscriptions renew automatically unless you cancel them in your platform account settings before the end of the current period. Uninstalling an App does not cancel a subscription. Prices and features may vary by country and platform and are always shown before you complete a purchase.

05Distribution platforms

These Terms are an agreement between you and HSY Labs, not with Apple, Google, Microsoft or any other platform. HSY Labs, not the platform, is responsible for the Apps and their content, maintenance and support, and for handling any claims relating to them, within the limits of these Terms.

If you obtained an App from the App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple will have no other warranty obligation regarding the App. HSY Labs, not Apple, is responsible for investigating, defending, settling and discharging any third-party claim that the App or your use of it infringes that third party’s intellectual property rights.

When using an App, you must also comply with any applicable third-party terms, and you confirm that you are not located in a country subject to an embargo, nor included in any government list of prohibited or restricted parties.

06Updates and availability

We may update the Apps to add features, fix errors or improve security, and some updates may be required to keep using an App. We may also modify or discontinue an App, or some of its features, at any time; where possible, we will give reasonable notice. Nothing in these Terms limits the rights you may have as a consumer regarding digital content and services.

07Intellectual property

The Apps, including their code, design, texts, graphics and trademarks, belong to HSY Labs or its licensors and are protected by law. These Terms do not transfer any ownership rights to you. Some Apps may include open-source components that are subject to their own licences.

08Third-party services

The Apps may include links to, or integrations with, third-party services. We are not responsible for those services, which are governed by their own terms and policies.

09Warranties

We work hard to make the Apps reliable and useful. However, to the extent permitted by law, the Apps are provided “as is” and “as available”, without warranties of any kind beyond those that cannot be excluded under applicable law. We do not guarantee that they will be uninterrupted or error-free, or that they will meet all your needs. If you are a consumer, you keep all the statutory rights granted to you by law.

10Limitation of liability

To the extent permitted by law, HSY Labs is not liable for indirect, incidental or consequential damages, such as loss of data, profits or business opportunities, arising from the use of, or the inability to use, the Apps. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be excluded or limited by law.

11Termination

You can stop using an App at any time by uninstalling it and, where applicable, deleting your account. We may suspend or terminate your access if you breach these Terms. The provisions that by their nature should survive termination will continue to apply.

12Applicable law

These Terms are governed by the law of the country in which HSY Labs is established, without prejudice to the mandatory protections granted to consumers by the law of their country of residence. Any dispute will be submitted to the courts that have jurisdiction under applicable law.

13Changes to these Terms

We may update these Terms from time to time. We will publish the new version on this page and, if the changes are significant, we will let you know through appropriate means. If you continue to use the Apps after the changes take effect, you accept the updated Terms.
